These Terms of Service ("Terms") govern your access to and use of the LifeStory mobile application and related services (collectively, the "Service") provided by LifeStory ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

LifeStory is a mobile application that helps you record and preserve your life story. The Service includes:

An AI-powered biographer that conducts audio interviews about your life
Automatic transcription of your audio recordings
AI-generated narrative prose based on your stories
Organization of stories into chapters and formatted books
PDF export of your completed book
Optional ordering of professionally printed books

3. User Accounts and Responsibilities

To use the Service, you must create an account. You agree to:

Provide accurate and complete information when creating your account
Maintain the security of your account credentials
Notify us immediately of any unauthorized access to your account
Be at least 13 years of age to use the Service
Accept responsibility for all activity that occurs under your account

4. Content Ownership

Your Content

You retain full ownership of all content you provide to the Service, including your audio recordings, transcripts, photos, and personal information ("Your Content"). We do not claim any ownership rights over Your Content.

License to Process

By using the Service, you grant us a limited, non-exclusive, worldwide license to use, process, store, and transmit Your Content solely for the purpose of providing and improving the Service. This includes sending your audio to transcription services, processing your transcripts through AI models to generate narrative text, and formatting your content into books. This license terminates when you delete your content or your account.

5. AI-Generated Content

The Service uses artificial intelligence to transform your recorded stories into polished narrative prose. You acknowledge and agree that:

AI-generated text is based on your recordings but may include creative interpretations, transitions, and narrative structure
You are responsible for reviewing and approving all AI-generated content before publishing or printing
We do not guarantee that AI-generated content will be perfectly accurate or complete
You own the final generated book content, including AI-generated portions, once produced for you

6. Subscription and Billing

Free Tier

The free tier includes up to 5 recorded stories, PDF export, one book template, and access to the AI biographer. No payment is required for the free tier.

Premium Subscription

Premium features are available for $49 per year. Premium includes unlimited stories, all book templates, video recording, printed book ordering, multiple book projects, and priority AI processing.

Billing and Renewal

Subscriptions are billed through the Apple App Store or Google Play Store. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription through your device's app store settings.

Refunds

Subscription refunds are handled according to the policies of the Apple App Store or Google Play Store. Contact the relevant app store for refund requests.

7. Printed Books

Premium subscribers may order professionally printed books through the Service. You acknowledge that:

Printed books are produced and fulfilled by a third-party print service
Printing and shipping costs are charged separately from your subscription
Delivery times vary based on your location and the print service's processing schedule
Print quality may vary slightly from the digital preview shown in the app
Returns and reprints for defective books are handled in coordination with our print fulfillment partner; contact support@getyourlifestory.com for assistance
We are not responsible for shipping delays or damage caused by carriers

8. Prohibited Uses

You agree not to use the Service to:

Record or upload content that infringes on the intellectual property rights of others
Record another person's story without their knowledge and consent
Upload content that is unlawful, defamatory, obscene, or harmful
Attempt to gain unauthorized access to our systems or other users' accounts
Use the Service for any commercial purpose other than creating your personal life story book
Reverse engineer, decompile, or disassemble any part of the Service
Use automated scripts or bots to access the Service
Interfere with or disrupt the integrity or performance of the Service

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not guarantee the accuracy, completeness, or quality of AI-generated content. AI models may occasionally produce inaccurate or unexpected results. You are responsible for reviewing all content before use.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIFESTORY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

You may terminate your account at any time by deleting your account through the app or by contacting us. We may suspend or terminate your account if we reasonably believe you have violated these Terms. Upon termination:

Your right to use the Service will immediately cease
We will delete your data in accordance with our Privacy Policy
Any outstanding print orders that have already been submitted will still be fulfilled
No refunds will be provided for any remaining subscription period unless required by law

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Texas.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
